Terms of Service
Last updated: 18 October 2026. What changed: new section 8B on AI apps and connectors.
These Terms of Service (the "Terms") govern your use of Tamarly Intelligence, the Tamarly Research store and related websites and services (the "Service"), provided by Tamarly Corporation ("Tamarly", "we", "us"). By creating an account or using the Service you agree to these Terms, the Terms of Access shown when you first enter the Service, the Subscription and Billing Terms, the Refund and Cancellation Policy, the Research Disclaimer, the Acceptable Use and AI Policy, the Copyright Policy and the Privacy Policy, which form part of them. Where the Terms of Access and these Terms differ, these Terms prevail.
1. Who may use the Service
You must be at least 18 and able to form a binding contract. If you use the Service for an organisation, you confirm you may bind it, and "you" includes that organisation. The Service is not offered where its use would breach local law. You must not be located, organised or ordinarily resident in a country or region subject to comprehensive United States sanctions, or be listed on, or owned or controlled by a person listed on, a sanctions list maintained by the United States, the United Nations, the European Union or the United Kingdom.
2. Your account
You are responsible for the accuracy of your account details and for keeping your credentials secure, including any sign-in through Google or Microsoft. Each account is for one named person. Sharing credentials or giving others access to your account is not permitted. Tell us promptly at security@tamarly.ai if you suspect unauthorised access.
3. Your licence to the content
Subject to these Terms and your plan, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and read the content available to your plan, and to download reports where your plan or purchase allows, for your own internal research. You may quote short extracts with attribution to Tamarly Research and the report ID.
If you are on a paid plan, you may also include content from the Service, such as figures, charts, tables and short quotations, in documents you prepare for your own internal use or for your clients, provided each item keeps its source and the attribution "Source: Tamarly Intelligence". This does not permit reproducing a Tamarly report in whole or substantial part, or making content available in a way that substitutes for a subscription.
You may not, without our written consent:
- copy, redistribute, resell, sublicense or publicly display reports or other content, in whole or substantial part;
- share downloaded files outside the licence holder;
- scrape, crawl or extract content or data in bulk, or use automated means to access the Service other than through features we provide;
- use any content to train, fine-tune or evaluate an artificial intelligence or machine learning model;
- remove copyright notices, report IDs or watermarks;
- reverse engineer, probe or test the security of the Service, or interfere with its operation.
4. Your content and portfolio data
You keep ownership of the information you add, including portfolio holdings, notes and the investment memos you build ("Your Content"). You grant us a limited licence to host and process Your Content only to provide the Service to you, as described in the Privacy Policy. We do not sell Your Content, use it to train models or share it with fund managers or other subscribers. You confirm you have the right to upload Your Content and that it does not infringe anyone's copyright or other rights.
Your Content includes files you upload, documents you write in the Hub, and the funds you keep in My Funds. When you share a document or a fund with other people, they can see what you share with them, within the role you give them, and you confirm you are entitled to share it. You can remove access at any time. A co-manager of a fund may see its holdings and notes but cannot share it further.
5. AI features
Some features use artificial intelligence, including Ask the Brain, the Tamarly Associate, the Hub writing assistant, the investment memo builder, and the automated reading of filings and annual reports that feeds company pages, the Brain cards and the knowledge graph. AI output can be incomplete or wrong, can cite figures that are out of date, and can misread a source. Tamarly checks that quoted sentences appear in their source, but does not review every AI output before you see it. Check AI output against its primary source before relying on it. AI output produced at your request is your own work product. It is not Tamarly research, a Tamarly opinion or investment advice.
5A. Linked data
The Service links companies, countries, commodities, regulations, organisations, sectors and funds, and shows each link with its source. A link records what its source says, for example that a company reports operations in a country or names a supplier. It is not a finding by Tamarly of control, ownership, a commercial relationship, sanctions exposure or wrongdoing, and it may be incomplete or out of date. Tamarly does not guarantee the accuracy, completeness or timeliness of any link or of the data behind it, and accepts no liability for any loss arising from reliance on it, to the fullest extent permitted by law (section 12). Grades (A to D, and U for your own files) describe the kind of source, not a guarantee of accuracy. Links and grades are not investment advice and must not be used in an investment decision without your own analysis and judgement.
6. Research, not advice
The Service provides general research and information. It is not investment, legal, tax or accounting advice and is not tailored to your circumstances. Tamarly is not a registered investment adviser or broker-dealer, does not recommend that you buy, sell or hold any security or fund, and does not execute transactions. The Research Disclaimer sets this out in full.
Ask the Brain and the other AI features present information, rankings, risks and opportunities with their sources. They do not recommend buying, selling or holding any security, fund or digital asset, because Tamarly is not authorised to give investment advice. Asking them to do so breaches these Terms. Such requests are refused and recorded; a repeated request within 24 hours is sent to Tamarly's administrators, who may review the account and act under section 10.
7. Third-party sources and links
The Service links to, and displays information from, public registers, regulators and other third parties listed in the Third-Party Data Notices. We do not control those sources and are not responsible for their accuracy, availability or terms. Your use of a third-party site is governed by its own terms.
8. Acceptable use
You may not use the Service to break the law, infringe others' rights, harass any person, compile profiles of private individuals, attempt to identify exposed systems or vulnerabilities, upload malicious code, or misrepresent your identity or affiliation.
8A. API
Where your plan includes it, you may call the Tamarly API as yourself, within the published rate limits (currently 1,200 calls an hour). API data is subject to the same licence as the Service. You may not use the API to build a database, compilation or service that substitutes for a subscription, or to pass data to people outside your licence.
8B. AI apps and connectors
You may connect an AI application, such as Claude or ChatGPT, to your account through our connector. When you do, the application reads data from the Service on your behalf, within your plan and the published rate limits, and these Terms apply to that use as if you made it yourself. Data an AI application receives from the Service is for your own research under section 3. You may not use a connector or an API key to redistribute data, to build a product or database for others, or to train, fine-tune or evaluate an artificial intelligence model. Keep your keys secret; anyone who holds one can read data as you until you revoke it in My Account. The AI application is provided by its own provider under its own terms, and we are not responsible for how it processes the data or for what it writes.
9. Intellectual property
The Service, its software, design, reports, data compilations, report IDs and the Tamarly names and marks belong to Tamarly or its licensors and are protected by law. Except for the licence in section 3, no rights are granted.
9A. Copyright complaints
If you believe material on the Service infringes your copyright, send a notice to our designated agent as described in the Copyright Policy, at contact@tamarly.ai or through https://app.tamarly.ai/copyright/report. We respond to notices that comply with the Digital Millennium Copyright Act (17 U.S.C. 512). We may remove or disable access to Your Content that is the subject of a notice, and we will tell you when we do. If you believe it was removed by mistake or misidentification, you may send a counter-notice as the Copyright Policy describes. We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others. Knowingly misrepresenting that material is infringing, or that it was removed by mistake, may make you liable for damages under 17 U.S.C. 512(f).
10. Suspension and termination
You may close your account at any time from the account page. If you pay for a plan, your subscription ends at the end of the period you paid for and the account closes on that date. A closed account is kept in archive for 6 years, then deleted, as set out in the Privacy Policy. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or other users, with notice where reasonable. Sections 3 (restrictions), 4, 5, 5A, 6, 9 and 11 to 15 survive termination. Access to reports published while you paid is governed by the Subscription and Billing Terms.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by law, Tamarly is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading or investment losses, or loss of data, arising from your use of the Service. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose, or $100 if you paid nothing. Some jurisdictions do not allow these limits, so they may not apply to you in full.
13. Indemnity
You will indemnify Tamarly against third-party claims arising from your breach of these Terms or your misuse of the Service, including any investment decision you make.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in New York, New York; you and Tamarly waive any right to a jury trial or to take part in a class action, except for claims that qualify for small claims court. Nothing here limits mandatory consumer protections in your country of residence.
15. Changes and general terms
We may update these Terms. We will give at least 30 days' notice of material changes by email or in the Service; continued use after the effective date means you accept them. These Terms are the entire agreement on their subject. If a provision is unenforceable, the rest remains in effect. Failure to enforce a right is not a waiver. You may not assign these Terms without our consent.
16. Video features
Video features show YouTube content through YouTube's own player. By using them you agree to the YouTube Terms of Service (youtube.com/t/terms). Open-licence video plays from its publisher's own address. Every video names its publisher and licence. To ask for a video to be removed, write to contact@tamarly.ai with the page and the item, or, for a copyright complaint, follow the Copyright Policy. Requests are actioned within 48 hours and logged.
17. Enterprise customers
If your organisation signed an Order Form with Tamarly, the Master Subscription Agreement and its Service Level Agreement apply to that subscription, and they prevail over these Terms where the two differ. The Service Level Agreement applies only to Enterprise customers.
